Among Aristides' extant works there are five speeches concerning the city of Smyrna, namely the first Smyrnaean oration , a monody for Smyrna , a letter to I Marcus and Commodus concerning Smyrna , a palinode for Smyrna and the second Smyrnaean oration . The historical context and purpose of Orr. 18, 19 and 20 are well known and uncontroversial. In contrast, although the dating of Orr. 17 and 21 relative to the others is not in doubt, their context and (...) purpose have been divergently interpreted. In this note I will reargue the case that the dominant modern scholarly tradition, which conceives the speeches as invitations to the emperors Marcus and Commodus respectively to visit Smyrna, is wrong. Rather the speeches were addresses of welcome to two proconsuls, father and son, on their respective arrivals in Smyrna. Secondly, I will briefly indicate the general significance of this identification. (shrink)

In an important recent article, A. Rodger expounded a cogent analysis of ch. 84 of the Lex Irnitana and especially of the logic of its account of the limits of the jurisdiction of the duumviri . He sums up his analysis of the jurisdiction of the duumviri as follows: ‘the picture which emerges is coherent, as we should expect. The duumvir has jurisdiction in cases up to 1,000 sesterces. In such cases the plaintiff may insist on his case being heard (...) locally unless it falls into one of the exempted categories. In that event, unless both parties agree, the duumvir will have jurisdiction only for vadimonium to be made to the governor who will in turn deal with vadimonium for a hearing before the praetor in Rome. If on the other hand both parties concur, the duumvir will have jurisdiction in exempted actions of up to 1,000 sesterces, the only exception being cases where an issue of free status arises. If such an issue does arise, the jurisdiction of the duumvir is restricted to dealing with vadimonium to the governor. In cases over 1,000 sesterces the duumvir has no jurisdiction unless both parties agree. If the parties do not agree, again the duumvir has jurisdiction only for vadimonium to the governor. If, however, the parties do agree, the duumvir has jurisdiction in all matters except again where an issue of free status arises. The Prologue offers an overview of the Reformation of method from Augustine of Hippo through to the Ramist movement, providing an orientation to the rest of the book. It highlights and explains an important nexus of Realism, exemplarism and illumination fundamental to Ramism. Beginning with Augustine it shows how these themes coalesced into a distinctive Christian philosophy taken up and refined by Franciscans such as Bonaventure of Bagnoregio and John Duns Scotus, as well as by Ramon Lull, the Franciscan-inspired encyclopaedist. It traces the continuation of this methodological impulse into the Platonism and Christian humanism of the Renaissance, highlighting especially the topical and Realist (Scotistic) reform of logic pioneered by Lorenzo Valla and Rudolph Agricola. It concludes by showing the reception of this topical and biblical reform in Philipp Melanchthon and the movement of Reformed scholasticism, revealing Reformed Scotism and Christian philosophy as important preconditions for Ramism. This book describes and explores six current approaches to the study of mind: the neuroscientific, the behavioral, the competence approach, the ecological, the phenomenological, and the computational. No other book in cognitive science covers such a broad range of research programs and topics in such a balanced fashion. The first chapter is a mini-history and philosophy of psychology which reviews some of the scientific developments and philosophical arguments behind these six different approaches. This study explores the underlying drivers of US public pension funds’ tendency to tilt their portfolios towards companies with stronger corporate social responsibility. Studying the equity holdings of large, internally managed US state pension funds, we find evidence that the political leaning of their beneficiaries and political pressures by state politicians affect funds’ investment decisions. State pension funds from states with Democratic-leaning beneficiaries tilt their portfolios more strongly towards companies that perform well on CSR issues, and this tendency is intensified (...) when the state government is dominated by Democratic state politicians. Moreover, we find that funds which tilt their portfolios towards companies with superior CSR scores generate a slightly higher return compared with their counterparts. Overall, our findings indicate that funds align their investment choices with the financial and non-financial interests of their beneficiaries when deciding whether to incorporate CSR into their equity allocations. This study presents a theory of causally complex configurations of antecedent conditions influencing the adoption versus non-adoption of international supplier ethical certification-standards. Using objective measures of antecedents and outcomes, a large-scale study of exporting firms in the cut-flower industry in two South American countries supports the theory. The theory includes the following and additional propositions. No single -antecedent condition is sufficient for accurately predicting a high membership score in outcome conditions; the outcome conditions include a firm’s adoption or rejection of (...) a product certification. No single -antecedent condition is necessary for accurately predicting high scores in the outcome condition. A few complex antecedent conditions are sufficient but the occurrence of each is not necessary for accurately predicting high scores in an outcome condition. Causal asymmetry of antecedent conditions indicating adoption versus non-adoption of specific ethical standards occurs—that is, causal conditions leading to rejection are not the mirror opposites of causal conditions leading to adoption. This paper investigates different modes of organizing for corporate social responsibility (CSR). Based on insights from organization theory, we theorize two ways to organize for CSR. “Complete” organization for CSR happens within businesses and depends on the availability of certain organizational elements (e.g., membership, hierarchy, rules, monitoring, and sanctioning). By contrast, “partial” organization for CSR happens when organizers do not have direct access to all these organizational elements. We discuss partial organization for CSR by analyzing how standards and cross-sector partnerships (...) make selective use of organizational elements. We maintain that an important feature of the increasing institutionalization of CSR—not only within businesses but also among non-governmental, governmental, and professional actors—is the rise of partial forms of organization. We discuss the contributions to this Special Issue in the context of our theorization of complete/partial organization for CSR and outline avenues for further research. (shrink)

Background: Multiple studies have shown that people who have experienced a serious health problem such as an injury tend to overrate the quality of health they had before that event. The main objective of this study was to test whether the phenomenon of respondents overrating their past health can also be observed in people from the general population. A second aim was to test whether habitual optimism is indeed focused on events in the future.Method: A representatively selected community sample from (...) Leipzig, Germany was examined. Respondents were asked to assess their current health, their past health, and their expected future health on a 0–100 scale. In addition, the study participants completed several questionnaires on specific aspects of physical and mental health.Results: Respondents of all age groups assessed their health as having been better in the past than it was at present. Moreover, they also assessed their earlier state of health more positively than people 5 years younger did their current state. Habitual optimism was associated with respondents having more positive expectations of how healthy they will be in 5 years time, but the correlation with their assessments of their current health was nearly as high.Conclusion: Highly positive scores of retrospectively assessed health among people who have experienced a health problem cannot totally be accounted for by a response to that health problem. Being able to state the principles which lie deepest in the foundations of mathematics by sentences in three variables is crucially important for a satisfactory equational rendering of set theories along the lines proposed by Alfred Tarski and Steven Givant in their monograph of 1987. The main achievement of this paper is the proof that the 'kernel' set theory whose postulates are extensionality. (E), and single-element adjunction and removal. (W) and (L), cannot be axiomatized by means of three-variable sentences. This (...) highlights a sharp edge to be crossed in order to attain an 'algebraization' of Set Theory. Indeed, one easily shows that the theory which results from the said kernel by addition of the null set axiom, (N), is in its entirety expressible in three variables. (shrink)

Recent developments in the cognitive sciences and artificial intelligence suggest ways of answering the most serious challenge to Peirce's notion of abduction. Either there is no such logical process as abduction or, if abduction is a form of inference, it is essentially unconscious and therefore beyond rational control so that it lacks any normative significance. Peirce himself anticipates and attempts to answer this challenge. Peirce argues that abduction is both a source of creative insight and a form of logical inference (...) subject to a degree of conscious control. In this paper I shall sketch a developing account of abduction that is suggested by the work of Paul Churchland, Paul Thagard, Chris Eliasmith, William Wimsatt, Owen Flanagan, and others. I shall argue that a credible account of abduction will require that we approach the phenomenon from both higher and lower levels as represented by these approaches. (shrink)

Die Beiträge des Bandes verdeutlichen: Um den Tod begrifflich angemessen zu fassen, muss die personale Dimension des menschlichen Lebens berücksichtigt werden.

Adolf Reinach’s theory of social acts and Czesław Znamierowski theory of the environment can show a new perspective of analysis in the fields of computer science and digital communication. This paper will begin analysing the performance of social acts in two categories of digital environments: (i) fictional digital environment and (ii) real digital environment. The analysis will be supported by examples from the history of computer science. In both kinds of digital environments, organigrams play a significant role and depend on (...) the users’ digital power to perform a real or fictional social act. Finally, the paper will analyse one of the possible roles that AI plays in performing social acts in digital environments. It will show how AI could affect the perception of social acts. (shrink)

While standard forms of discrimination are widely considered morally wrong, philosophers disagree about what makes them so. Two accounts have risen to prominence in this debate: One stressing how wrongful discrimination disrespects the discriminatee, the other how the harms involved make discrimination wrong. While these accounts are based on carefully constructed thought experiments, proponents of both sides see their positions as in line with and, in part, supported by the folk theory of the moral wrongness of discrimination. This article presents (...) a vignette-based experiment to test empirically what, in the eyes of “folks”, makes discrimination wrong. Interestingly, we find that, according to folks, both disrespect and harm make discrimination wrong. Our findings offer some support for a pluralistic account of the wrongness of discrimination over both monist respect-based and monist harm-based accounts. (shrink)

This paper examines the philosophical basis for the argument that there is a connection between ethical behavior and profitability. Both sides of this argument – that good ethics is good business and that bad ethics is bad business – are explored. The possibility of a moral floor above which ethical behavior is not rewarded is considered, and an economic experiment testing such a proposition is discussed. Johnson & Johnson suffers a potentially devastating blow when some cyanide-laced Tylenol capsules cause several (...) deaths. Johnson & Johnson voluntarily pulls Tylenol off the shelf, to universal acclaim. When Tylenol is returned to the marketplace, its share of the over-the-counter painkiller market becomes greater than it was before the tragedy. Arthur Andersen, the venerable accounting firm, is caught in the web surrounding the downfall of Enron, Inc. As Enron’s various sins are discovered, it is found that Arthur Andersen auditors had signed off on flawed audits and had shredded documents to cover themselves. Andersen is prosecuted for, and convicted of, obstructing justice (although the conviction is later overturned). Today the firm barely exists and has no resemblance to the Big Five accounting giant of 1999. These stories seem to indicate that ethical (or unethical) behavior leads to positive (or negative) financial results. But the philosophical arguments underpinning such statements are seldom subjected to proper analysis. They are perhaps wishful thinking, or perhaps based on examples such as the above without considering other examples that may reinforce a contrary position. This paper will explore the philosophical arguments and empirical evidence regarding these statements and state some research questions for exploration in this area. In particular we will propose the possibility that a moral floor exists above which firms that engage in ethical activities will not reap rewards, but below which firms that engage in unethical activities will be punished by actors in the economic marketplace. We will discuss an economic experiment to determine if such actors indeed form a moral floor. (shrink)

This study empirically analyses the exclusion of companies from investors’ investment universe due to a company’s business model or due to a company’s violations of international norms. We conduct a time-series analysis of the performance implications of the exclusion decisions of two leading Nordic investors, Norway’s Government Pension Fund-Global and Sweden’s AP-funds. We find that their portfolios of excluded companies do not generate an abnormal return relative to the funds’ benchmark index. While the exclusion portfolios show higher risk than the (...) respective benchmark, this difference is only statistically significant for the case of GPFG. These findings suggest that the exclusion of the companies generally does not harm funds’ performance. We interpret these findings as indicative that with exclusionary screening, as practiced by the sample funds, asset owners can meet the ethical objectives of their beneficiaries without compromising financial returns. From a simple idea to unite asset owners in their quest for responsible investment at its launch in April 2006, the United Nations supported Principles for Responsible Investment have grown in just one decade into an initiative with more than 1500 fee-paying signatories. Jointly, the PRI’s signatories hold assets worth more than $80 trillion, making it one of the more prevalent not-for-profit organizations worldwide. Furthermore, the PRI’s ambitious mission to transform the financial system at large into a more sustainable one (...) makes it a worthwhile subject of inquiry from an institutional perspective. We undertake an empirical investigation of the adoption of the PRI by asset owners during five crucial years of the association’s emergence: 2007–2011. Following a tripartite view of institutional theory proposed by Scott, we explore if regulative, normative, and cultural–cognitive factors influence an asset owner’s decision to subscribe to the PRI. Applying both parametric and non-parametric survival analysis, we find that asset owners are indeed significantly affected by normative, cultural–cognitive, and regulative aspects. In particular, public service employee and labor union pension funds from social backgrounds more culturally aligned with values represented by the RI movement with historically more voluntary legislation on environmental, social, and governance issues are most likely to sign the PRI. In contrast, institutional environments with a higher number of pre-existing mandatory ESG regulation decrease the likelihood of signing the PRI. Our results indicate that normative and cultural–cognitive factors were crucial contributors to the PRI’s growth. With respect to the regulative environments, our results imply that some asset owners may use the PRI as a collective industry initiative to substitute for mandatory legislation. Conversely, a high level of historical mandatory legislation may constrain organizational resources that could otherwise be dedicated to voluntary initiatives such as PRI. Our findings are robust to relevant controls and econometric concerns. (shrink)

In recent years evidence has emerged of the considerable influence of Scotist metaphysics on the Reformed scholasticism of the seventeenth century. One of the figures often named in connection with this Scotist revival is Samuel Rutherford (1600–61), who was one of the most important Scottish theologians of the seventeenth century. Focussing on Rutherford’s maximalist doctrine of providence, this article demonstrates his profound debt to key Scotist philosophical devices. In structuring these concepts, however, it is demonstrated that Rutherford is influenced not (...) so much by Scotus directly but rather much more by the modified Scotism of Thomas Bradwardine, the fourteenth-century Augustinian theologian. In particular, Bradwardine is revealed as the key influence on Rutherford’s modal theory and his sophisticated account of divine concourse. The paper concludes by arguing that Bradwardine’s influence on Rutherford suggests the need to take a broader view of the late medieval influence on Reformed scholasticism than is currently the case. The present paper explores, theoretically, and empirically, whether compliance with the International Code of marketing of breast-milk substitutes impacts on financial performance measured by stock markets. The empirical analysis, which considers a 20-year period, shows that stock markets are indifferent to the level of compliance by manufacturers with the International Code. Two important issues emerge from this result. Based on our finding that financial performance as measured by stock markets cannot explain the level of compliance, the first issue refers to (...) what alternative types of mechanisms drive manufacturers who comply the least with voluntary codes such as the International Code. Conversely, from our finding that stock markets do not reward the most compliant, the second issue raised is an inherent weakness of stock markets to fully incorporate social and environmental values.
